Intellectual property rights

Posted by Pat Cho on July 16, 2001, at 23:45:32

http://www.dr-bob.org/babble/20010714/msgs/70358.html

This is not the first time a person has posted on this site a long list of electronic journals with user names and passwords. In some cases publication of user names with passwords can be a crime. If the passwords were issued to SA4M, then their publication might be a civilly or criminally actionable violation of user agreements with the listed publications. If the user names are those of somebody else, then the post seems to be a case of identity theft, which violates federal laws and the laws of whatever state where the post was made.

There have also been repeated postings on this site of copyrighted materials. Perhaps there needs to be a notice in the FAQ encouraging users to recognize the property rights of other publications.

While SA4M apparently meant well by posting this information, it puts the site at risk. Somebody will notify the listed journals that their security has been breached and they might decide to take action against dr-bob.org.

I am truly concerned about SalArmy4me! Does anyone live near him? Or know him personally? Or is this the price we pay for socializing through the net?

Robert H,
Yeh, right. In this circumstance, the message was intended for people who might get in legal trouble as a result of a situation you created. It was not directed to you. It was to protect people from you.

I find it quite amusing that this person has used a quote from a supreme court case where the justice is defining obscenity. I would love to see a thread develop as to the psychological reasoning why this person would think that quote fits in this situation! As anyone knows, I am not a big SalArmy4me fan - but he is nowhere in my mind obscene - agressive in his trying to help, maybe, but not obscene . . . now the attempts of the person making this quote . . . oops, don't want to call anyone a name . . . so I won't go there . . .

I assume it was taken from the FAQ, where I apply it to civility:

http://www.dr-bob.org/babble/faq.html#civil

As far as psychological reasoning, I agree, let's not go there.

While, yes it is wrong to give out passwords, but given that anyone who wants to see these sites just has to register and get a password to see them. No money involved. One step away from public access. I question calling this a violation of "Intellectual property rights"

The term “intellectual property rights” is the term used by the legal departments of the publishers. Several of the publications describe their rights as “intellectual property rights”, as you may see from these few user agreements excerpted here under the fair use clause 107 of the U.S. copyright code.

A review of the first few of about 70 on-line journals and resources listed shows most charged substantial subscription fees. A review of the remaining journals suggests they comprise a very high-quality and specialized genre of journals, which typically sustain their efforts by charging substantial fees.

Some of the listed journals offer free trial subscriptions, but the extensive list of costly usernames and passwords posted seemed to suggest it originated at a well-funded institution. Many of the usernames included the words "logan" and "library", suggesting the information might have originated from the Quad-L (Logan) Library in the Department of Psychology at the University of New Mexico. One of the usernames posted was that of a long-time and regular contributor to the Psycho-Babble boards.

james here....

It's more of a moral question. Short answer is if you use them, you would be stealing. You have to deside this based on your ethical standards.

Should you use someones elses computer ? Only if you don't like them ! Better to use a computer that lots of people use.

In truth I think no one will notice.
