straterra generic or not in Canada

I don't understand. I was under the impression that straterra was approved for generic production little while back now. Are there still no generic versions in Canada? Why?

Nah, Lilly appealed that and won. Have patent till 2017, I think. I get news feed on Strattera.

Here's an AP article from Friday:

"INDIANAPOLIS (AP) A federal appeals court overturned a ruling that would have allowed for generic sales of an attention deficit hyperactivity disorder drug produced by Eli Lilly, the company said Friday.

The U.S. Court of Appeals for the Federal Circuit determined that the patent for Strattera is valid, Lilly said The decision blocks generic versions of Strattera from the market until May 2017. Generic drugmaker Actavis was challenging the patent.

The initial ruling was made about one year ago in New Jersey. Lilly said generic competition for Strattera would put a significant dent in its sales, and it said it would cut $1 billion in annual spending to offset that ruling and other upcoming patent decisions and expirations.

The Food and Drug Administration approved the Actavis generic in September, but the product did not go on sale because Lilly was appealing the earlier court ruling.

Strattera, or atomoxetine, was approved in May 2008. Sales fell 5 percent to $576.7 million in 2010, although revenue from the drug rose 1 percent in the first half of 2011.

Shares of Eli Lilly and Co. rose 25 cents to $38.25 in afternoon trading."

Sorry, link. I am so blessed to have great insurance paying for this med for the past 7+ years. I pay about $9.00 a month when I know it's listed at nearly $300.00. Highway robbery, it seems.

Yeah, its discusting how much they charge.

A month of generic ritalin barely costs me 1/10 of this.

Anyhow, I wonder if this ruling is the same for Canada, as I heard (for a while) that a generic was coming to Canada but not the US.

Link, the Canada Drug database shows the med as only being available in brand name. I don't know when this will change. Most drugs usually go generic much faster in Canada. I had read the lovely Harper government is trying to change this. Just what we need...ya right.

Great point. Slipped right by me, too. International patent law of some sort must come into play there and although I have a lot of legal background in some parts of U.S. law, I have no clue how drug companies deal with this one.

Can't imagine they wouldn't at least try to keep conditions the same internationally as well, as long as they can.

I wonder if Lilly (and others) has a Canadian division and maybe that's who deals with this, under your laws....hmmm..
